Privacy Policy

Your privacy is important to us.Privacy Policy effective date: 30 March 2023

When you use our services, you’re trusting us with your information. We understand this is a big responsibility ­and will work hard to protect your information.


At Wingspan we take the privacy of personal information seriously and comply with the New Zealand Privacy Act 2020 and Health Information Privacy Code 2020.

What our privacy policy covers.

This Privacy Policy is meant to help you understand what information we collect, why we collect it, the steps we take to protect it, how we may use and disclose it. It also tells you about your rights with respect to your Personal Information, and how you can contact us to update your information or get answers to questions you may have about our privacy practices.

  • By providing Wingspan with personal information, you consent to the collection, retention, use and disclosure of your personal information in accordance with this privacy policy or as otherwise agreed with you.
  • “Personal information” means any information relating to a particular individual that can identify that person, either directly or indirectly (i.e., by reference to other information we have access to). We collect information to provide better services to all our users.
  • “Health information” means any information or opinion about the health of an individual that is also personal information.
  • “data” means information (including Personal Information) which you have provided Wingspan, which is collected and includes files, data, metadata, text, photographs, and written posts.

Types of information we collect.

The personal information we may collect and hold about you depends on the nature of your interaction with us. This information may include any or all of the following:

  • name
  • contact information
  • location
  • computer or network data
  • interactions with us
  • billing or purchase information
  • donation amounts and dates

How we collect personal information.

We may collect personal information about you either directly from you or from third parties such as contractors, service providers, suppliers, fundraising providers, social media websites or data aggregators who are acting on behalf of us or you have authorised, in accordance with the Privacy Act and Health Information Privacy Code 2020.

  • When you subscribe to our newsletter via our website, we collect your email address. You can opt out anytime by clicking on the unsubscribe button provided in the email.
  • When you email us, we collect your email address and any information you provide in such email.
  • When you contact us for support, we collect your email address (if provided) and information you share with us via online forms, direct conversations, emails, or telephone calls. Note: We may also record support calls to assist us in improving our service.
  • Each time you use the website we automatically collect information on our server logs from your browser or device app, including your IP address or unique device identifier, geolocation, browser type, browser language, information about your device type, operating systems, and type of operating system (e.g., IOS or Android), cookies (for web), user ID (for app) and the pages or screens you request. App data can also include time spent in a session on the app or feature in the app. Cookies can be disabled via your web browser. However, doing so may limit your access to some of the website’s content and features.
  • Where required in relation to your participation in a particular charitable fundraising event, we collect additional information from you, for example dietary requirements or emergency contact details.
  • When you donate, Wingspan uses the online fundraising platform Raisely, provided by Raisely Pty Ltd to collect personal information you provide us, including names, addresses, telephone numbers, email addresses and donation dates and amounts, and anything else that you send to us.

We collect statistical information about your visit to our website and social media via third party tools such as Google Analytics. This information is collected via these analytics tools to understand how our website and social media sites are being used; gain insights about how we can improve the functionality and user experience; and understanding browsing behaviours to give you a better experience whilst visiting our sites. We may share non- personally identifiable information such as usage and volume statistics, with our partners for the purposes of collaborating on research projects or with third parties that we may believe may benefit from our research.

 

Some donors prefer anonymity. We will respect the wishes of contributors who prefer their gift to remain confidential, to the extent we can legally do so. We will not use your personal information for any other unrelated purpose without first seeking your consent.

What happens if the information is not provided?

You do not have to provide your Personal Information when requested. However, you may not be able to benefit from our Services if that information is necessary to provide you with the Service, or it may not be possible to process your donation or request.

How we may share your personal information

We do NOT sell, rent, or trade your personal information with third parties for their promotional purposes.

Counselling is based on a confidential relationship. That is, the fact that you are receiving counselling, and what is discussed in sessions, will always remain confidential between you and Wingspan.

The only exception to this is in the following circumstances:

  • Where we consider that disclosure is necessary to prevent or lessen the risk to public health or safety, or to an individual’s life or health.
  • Where it is legally required by a third party, government agency or law enforcement authority in any jurisdiction (for example in response to a court order), or where we believe it is necessary to take action to protect to the safety of anybody on our premises.
  • Our agents and contractors and third parties that support our Services may have access to personal information to help carry out the services they are performing for us.

Occasionally you or your counsellor might consider it necessary or helpful to speak to another person about your care e.g., your GP, a mental health team, or another person. Your counsellor must fully explain to you why they believe this to be necessary or helpful and ask you to sign a consent form stating that you are happy for your counsellor to exchange information about you with another person, either in writing (by letter or email), or verbally (face to face or by telephone).

 

Should your counsellor believe it would be necessary or helpful to release information about you in the future, they will need to again obtain your consent and have you sign another form at that time

Communications with you

If you wish to stop receiving marketing communications from us, then please click on the ‘unsubscribe’ link on the relevant mailing.

 

If you would like us to delete your information from our records, please email hello@wingspan.org.nz and we will respond within a reasonable time. Please note that we may be required to keep certain information by law and/or for our legitimate business purpose.

Links to other sites

Our Services may contain embedded content or links to website or service provided by third parties. If you click on a link to a third-party site, you will be taken to a website, app (e.g., Facebook, Instagram) or service we do not control. Any information you provide on third-part sites or services may be provided directly to the operators of such services and what they do with your information is governed by their privacy policies, even if accessed through our Service. We are not responsible for the privacy practices of any other site or services that may be accessible through our Service and recommend that you carefully review the privacy policies of each website you visit.

Social media

If you participate in a discussion forum, local communities, social media, or discussion board on a Wingspan website, you should be aware that the information you provide there (i.e., your public profile and comments) will be made broadly available to others, and could be used to contact you, send you unsolicited messages for purposes neither Wingspan nor you have control over. Please also recognise that individual forms and discussion boards may have additional rules and conditions. Wingspan is not responsible for the Personal Information or any other information / data you choose to submit in these forums. We encourage you to review the privacy and settings of the social media website and app you interact with.

We will retain your personal information for as long as it is needed to provide the Services you have requested, and in any event, for no longer than information may lawfully require.

 

We take reasonable steps to destroy or permanently de-identify personal information in accordance with any applicable laws. Important to note: If you leave a comment on our website or social media account, the comment and its metadata are retained indefinitely.

Storage and security

The security of your personal information is important to us. We use physical, electronic, and procedural safeguards to protect your personal information.

  • We use encryption (SSL protocol) to keep your data private while in transit. We use 2-Step Verification security features.
  • We review our information collection, storage, and processing practices, including physical security measures, to prevent unauthorized access to our systems.
  • We restrict access to personal information to only those employees, and third parties who require it to provide our services and administrative support. We have a strict hierarchy of access rights in place and access to financial information and counselling notes are strictly limited.
  • Anyone with this access is subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.


No data transmission over the internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk.


Once we receive your transmission, we make efforts to ensure security on our systems. In certain areas, we use industry-standard encryption to protect data transmissions, however, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software.


From time to time, we may ask third-party service providers to help us manage our information technology systems. Some of these systems may be located outside New Zealand. We will only transfer your information to a third-party service provider where we are satisfied that adequate levels of protection are in place to protect the integrity and security of any information being processed and that the provider's protections and systems would comply with, or provide comparable safeguards to New Zealand privacy and data protection laws.


You are also responsible for helping to protect the security of your personal information. For instance, never give out your password, and safeguard your username and password when you are using our online Services. You are responsible for maintaining the security of any device on which you access our Services or communicate with us.

Access and correction of information

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you’d like to ask for a copy of your information, or to have it corrected, please contact us at the address | email set out below.


If you want to complain about an interference with your privacy, we encourage you to lodge the complaint with us in writing (using the contact details set out below). We will respond to the complaint within a reasonable time and within any applicable timing requirements prescribed by law, to try and work with you to resolve the issue.
